Context

The listings are new or edited offers from business sellers on Marketlane, a general online marketplace for new goods that sells to consumers in the EU. Each listing is checked before it goes live. The answers set its place in the moderation queue; a moderator decides every restriction or removal and writes the reasons sent to the seller. Judge the item offered, not single words: a "knife pleat skirt" is clothing, a "palette knife" for painting is an art tool. Marketlane prohibited items (never allowed): - Weapons: firearms and their parts, ammunition, replica or imitation firearms, stun guns, pepper spray. - Drugs and paraphernalia: controlled drugs, and equipment sold for using or growing them. - Prescription medicines, and any injectable medicine. - Recalled or banned products: an item the listing itself says is recalled, banned or failed a safety test. - Counterfeits and replicas: imitations of a brand, however described. - Live animals. - Accounts and personal data: logins, game or social media accounts, identity documents, lists of personal data. - Currency and financial products: cash, gift card resale, loans, investments. Marketlane restricted items (allowed only for approved sellers, and only with the checks named): - Knives and bladed articles: kitchen knives, folding and locking knives, axes, multi-tools with a blade. Age-checked delivery. - Alcohol. Age-checked delivery. - Tobacco and nicotine: cigarettes, vapes, e-liquids, nicotine pouches. Age-checked delivery. - Adult products: only in the adult category. - Hazardous chemicals: pesticides, strong acids and alkalis, pool chemicals. Household pack sizes only, with safety information. - Non-prescription medicines and supplements: approved sellers only. Listing rules for every seller: - No contact or payment outside Marketlane: no phone numbers, messaging apps, email addresses, links to other shops, or requests to pay by bank transfer or gift card, however spelled or disguised. - No claim that a product treats, cures or prevents a disease or medical condition. - The listing sits in the category that fits the item. Product safety information (EU General Product Safety Regulation, Regulation (EU) 2023/988, Article 19): an online offer of a consumer product clearly shows at least the manufacturer's name, registered trade name or registered trade mark, with a postal address and an electronic address; where the manufacturer is not established in the EU, the name, postal address and electronic address of the responsible person in the EU (the United Kingdom, Switzerland and Norway are outside the EU); information that identifies the product, including a picture, its type and any other product identifier; and any warning or safety information that must go on the product, its packaging or an accompanying document, in a language consumers can easily understand. Marketlane asks for these in the product safety section of the form, and they may also appear in the description. This check does not make a listing compliant; it flags gaps for the seller and the moderator.

Questions

  1. Under the marketplace policy, which prohibited or restricted category does the item offered fall in? Choice

Read the title, description and category. Judge the item actually offered, including anything included with it, against the prohibited and restricted lists in the context. Judge the item, not single words that also have innocent meanings. When the item fits a prohibited category and a restricted one, pick the prohibited one.

    • Allowed The item offered is in no prohibited or restricted category of the policy.
    • Weapons (prohibited) Firearms or their parts, ammunition, replica firearms, stun guns or pepper spray.
    • Drugs or paraphernalia (prohibited) Controlled drugs, or equipment sold for using or growing them.
    • Prescription medicine (prohibited) A prescription-only medicine, or any injectable medicine.
    • Recalled or banned product (prohibited) The listing itself says the item is recalled, banned or failed a safety test.
    • Counterfeit or replica (prohibited) The listing offers an imitation of a brand rather than the genuine product.
    • Live animals (prohibited) A live animal of any kind.
    • Accounts or personal data (prohibited) Logins, online accounts, identity documents or lists of personal data.
    • Currency or financial product (prohibited) Cash, resold gift cards, loans or investments.
    • Knives or bladed articles (restricted) A knife, blade, axe or multi-tool with a blade, sold alone or in a set or kit.
    • Alcohol (restricted) An alcoholic drink, or a gift set or kit that contains one.
    • Tobacco or nicotine (restricted) Cigarettes, tobacco, vapes, e-liquids or nicotine pouches.
    • Adult products (restricted) Sexual products or explicit material for adults.
    • Hazardous chemicals (restricted) Pesticides, strong acids or alkalis, pool chemicals and similar substances.
    • Non-prescription medicine or supplement (restricted) A medicine sold without prescription, or a food supplement, that is not injectable.
  2. Does the listing suggest the item is not genuine? Yes / No

Read the title and description for signs that the item imitates a brand: words such as replica, rep, 1:1, AAA quality, mirror quality, same factory, inspired by, unbranded version of, or a brand name misspelled or broken up to dodge filters. A genuine item described as used, refurbished or unboxed is not a sign. Yes: The listing contains at least one such sign. No: Nothing in the listing suggests the item is an imitation.

  3. Does the listing ask buyers to contact the seller or pay outside the marketplace? Yes / No

Our rule: no contact or payment outside Marketlane. Look for phone numbers, messaging apps, email addresses, social media handles, links to other shops, and requests to pay by bank transfer, gift card or cash. Count numbers written as words or split up, and apps named by a nickname such as "the green app". Yes: The listing invites contact or payment outside the marketplace in any of these ways. No: The listing keeps contact and payment on the marketplace.

  4. Does the listing claim the product treats, cures or prevents a disease or medical condition? Yes / No

Our rule: no claim that a product treats, cures or prevents a disease or medical condition. General comfort or wellbeing words ("relaxing", "soft on skin") are not a disease claim. A safety statement such as "stays cool" is not a disease claim. Yes: The listing says or implies the product treats, cures, prevents or relieves a disease or medical condition. No: The listing makes no such claim.

  5. Does the listing give the warnings or safety information its product type needs? Choice

First judge whether the product type normally comes with warnings, age limits or instructions for safe use: toys and children's products, electrical items, anything with a battery, chemicals, cosmetics, childcare products and protective gear do. Then read the description and the product safety section for such warnings or instructions. A seller's own reassurance ("totally safe", "never gets hot") is not safety information.

    • Not needed The product type does not normally carry warnings or safety instructions, such as a plain T-shirt or a book.
    • Given The product type needs warnings or safety instructions, and the listing gives them.
    • Missing The product type needs warnings or safety instructions, and the listing gives none, or only the seller's reassurance.
  6. Does the listing name the manufacturer, and an EU responsible person where one is needed, each with a postal and an electronic address? Choice

Read the product safety section and the description. Apply the product safety information rule in the context: the manufacturer's name with a postal address and an electronic address, and, when the manufacturer's address is outside the EU, a responsible person in the EU with a postal address and an electronic address. Judge where the manufacturer is established from the address given. A field label with nothing after it counts as not given. When there is more than one gap, pick the manufacturer's own gap first: Manufacturer not named, then Manufacturer address missing, then EU responsible person missing.

    • Complete The manufacturer is named with a postal and an electronic address, and either it is in the EU or an EU responsible person is named with a postal and an electronic address.
    • EU responsible person missing or incomplete The manufacturer is named with both addresses, outside the EU, and no EU responsible person is given with a postal and an electronic address.
    • Manufacturer address missing A manufacturer is named, but its postal address, its electronic address or both are missing.
    • Manufacturer not named The listing names no manufacturer at all.
  7. Is the item clearly outside the category the seller chose? Yes / No

Compare the item offered with the category path the seller chose. Count a mismatch only when the item plainly belongs elsewhere, such as a knife set filed under Gifts, or vapes under Home fragrance. A reasonable neighbouring category is not a mismatch. Yes: The item clearly belongs in a different category. No: The chosen category fits the item, or is a reasonable neighbour.

  8. Does the listing describe the item well enough to judge it against the policy? Yes / No

Judge whether the title and description say what the item is and what comes with it, so a moderator could apply the policy without asking the seller. Yes: The listing says what the item is and what is included. No: The listing is too short, vague or garbled to tell what is being sold.

  9. What should happen to this listing before it goes live? Choice

Judge the listing as a whole against the policy and the listing rules in the context. This is a suggestion for the moderation queue; a moderator decides every restriction or removal.

    • Publish The item is allowed, the listing breaks no rule, and no required information is missing.
    • Ask the seller to fix it first The item is allowed and the listing breaks no rule, but safety or manufacturer information is missing or the category is wrong.
    • Send to a moderator The item is restricted, or the listing shows a signal a person must check, such as possible counterfeit wording or a disease claim.
    • Priority review The listing appears to offer a prohibited item, or plainly breaks a listing rule such as asking buyers to pay outside the marketplace. A moderator should look first.
